These terms and conditions of hire are an agreement between you the ‘Hirer’ ( means any person, company or corporation) who hire equipment from the Owner (the ‘Owner’ means Brellico ABN 467 394 42363). ‘Terms’ (means these Hire Terms and Conditions).
Hire Period and Time Limits
A standard hire is based on delivery the day before the event date and return no later than 3 days after initial collection. Should the hirer exceed the contracted time limit, then the hirer will be charged additional hire fees. Any hire extension requires prior approval from the owner. The owner will do their best to accommodate such a request; however the hirer acknowledges this may not be possible.
Ownership
The equipment supplied for hire remains at all times the property of the owner.
Charges and Terms
The Hirer agrees to pay the owner’s hire charge and any other charges, including charges for loss, damage and repairs or other expenses from the commencement date until the equipment is returned. If the Hirer requests that the owner transport the equipment to or from the owner’s premises, the Hirer shall pay the owner all charges and expenses incurred by the owner in delivery, installing and collecting the equipment in addition to the hire charges. If applicable the relevant rates will be agreed upon at time of booking. The owner reserves the right to amend or revise its rate or prices without notice.
Payment Terms
Full payment required 2 months prior to the event date.
Security Bond
A security bond will be taken at time of booking if required and refunded when hire equipment has been returned in clean working order. Damaged or unclean items will incur a cleaning or replacement fee which will be deducted from the bond amount.
Cancellations
a) cancellations more than 21 days prior to the delivery date will incur a fee of 50% of equipment hire.
b) cancellations less than 21 days prior to the delivery date will result in forfeit of all hire fees.
Loss of or Damage to Equipment
If on the return of the equipment to the owner the equipment is found by the owner to be in an unclean condition or not in a working order, the Hirer shall pay to the owner the cost and expense of restoring the equipment to a clean condition and good working order. The Hirer accepts full responsibility to compensate the owner for the value of the equipment or parts thereof which may be lost or stolen from the time of commencement of delivery until the equipment is returned to the owner’s premises or collected by the owner. This right shall not be prejudiced by or prejudice any other right under these terms.
The Hirer’s Obligations
The Hirer must:
(a) accept responsibility for the equipment hired from the time of its delivery until returned to the owner;
(b) assume the risk of and indemnify and hold the owner harmless from and against any and all property damage and personal injury resulting from:
(i) the use of the equipment;
(ii) contact with underground cables, pipes, services or other obstruction;
(iii) all necessary service repairs;
(c) use the equipment in a proper, safe and prudent manner and only for the purpose and capacity for which it was designed;
(d) ensure all equipment is returned or ready for collection in a clean, dry and properly packed condition. The Hirer must pay all cleaning and drying costs and for any damage resulting from not properly drying, cleaning or packing the equipment.
Acceptance of Terms and Conditions
The Hirer hereby unconditionally accepts these terms and acknowledges that its acceptance is a condition precedent to taking possession of the equipment from the owner.
Privacy Policy
Collection of Information We may require additional information from you to assist in providing the best possible service to you. All correspondence may also be collected and stored, particularly in regards to sales, support and accounts, including email and other contacts details. The security of your personal information is important to us. We stringently follow industry accepted standards to protect the personal information submitted to us. The Hirer consents to Brellico to use event photos for marketing purposes provided to Brellico whether for profit or not.
Orders
When you purchase a product or service from us, we will request certain personal information (such as name, email and address). This information is for billing purposes and on occasions to contact you to clarify details about your order.
Legal Obligations
We reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceedings, court order or legal process served.
Liability
The hire company shall in no way be held responsible or accountable for any damage, injury, death or loss of income caused to the client, any third parties or properties due to the hire of equipment or provided services by the hire company. All equipment is hired and is the responsibility of the client until returned to the hire company.
Liability to third parties
The Customer hereby indemnifies and holds indemnified Brellico from and against all claims, actions, suits, demands and expenses in any way arising from injury, death, loss of income or damage caused to the hirer or its property, or any other third parties or property, in respect of the umbrellas or products hired from Brellico.
Acceptance of Terms & Conditions
By paying the full amount 2 months prior the Customer hereby unconditionally accepts the above terms and conditions and acknowledges that its acceptance is a condition precedent to taking possession of the umbrellas or hire products from Brellico.
Governing law
This Agreement will be construed in accordance with and governed by the laws of Western Australia. Each party submits to the non-exclusive jurisdiction of the courts of Western Australia in connection with matters concerning this Agreement.
